1. Introduction
Registered products containing sodium fluoroacetate (1080) are approved by the Australian Pesticides and Veterinary Medicines Authority (APVMA) for the control of a variety of vertebrate pests in Victoria, being rabbits, wild dogs, foxes and feral pigs. The use of 1080 pest animal bait products is one element of pest management and should only be used as part of an integrated pest animal control program. Effective pest animal management requires planning, the use of a range of control tools and close cooperation with adjoining land managers.
1080 pest animal bait products are available to users in two formulations; shelf-stable baits and perishable (short-life or fresh) baits. Shelf-stable baits include dried meat baits and dry oat baits. Perishable baits are a fresh bait product that must be used within 3 days of the date of manufacture. Liver, carrot and boneless red meat are examples of perishable baits.
1080 poison is included in Schedule 7 (Dangerous Poison) of the Standard for the Uniform Scheduling of Drugs and Poisons. Schedule 7 poisons have a high potential for causing harm at low exposure and require special precautions for handling and use. Schedule 7 poisons are available only to authorised persons who have the knowledge and skills to handle them safely.
The only 1080 pest animal bait products legally available for users in Victoria are:
- APVMA-registered products; and
- Perishable baits made using registered 1080 Aqueous Solution and supplied in accordance with an APVMA permit.
It is illegal for anyone, including 1080 pest animal bait users, to manufacture a shelf-stable or perishable 1080 pest animal bait product without having a manufacturing licence from the Victorian Department of Human Services (DHS).
1.1 Purpose of the Directions for the Use of 1080 Pest Animal Bait Products in Victoria
This document outlines the use of 1080 pest animal bait products in Victoria in accordance with relevant legislation. It is a legal requirement that all persons using 1080 pest animal bait products in Victoria use them in accordance with:
- the 1080 pest animal bait product label; and
- the relevant Material Safety Data Sheet (MSDS); and
- this document.
This document emphasises the responsibilities of the bait user to ensure that any risks associated with the use of 1080 pest animal bait products are managed appropriately. This document is also designed to promote the safe use of 1080 pest animal bait products in Victoria.
2. Relevant Legislation for 1080 Pest Animal Bait Product Users
Users of 1080 pest animal bait products are required to comply with the following legislation1 as well as any associated Regulations Standards Codes and statutory requirements.
The onus is on the user of 1080 pest animal bait products to comply with the directions on the product label and relevant legislative provisions.
Commonwealth Legislation: The Agricultural and Veterinary Chemicals Code Act 1994 classifies 1080 as a restricted chemical product. This means that 1080 pest animal bait products are only available to 'authorised persons' who have the skills necessary to handle them safely. This Act also contains regulations that restrict the availability storage and use of the product.
State Legislation: The Agricultural and Veterinary Chemicals (Control of Use) Act 1992 and Agricultural and Veterinary Chemicals (Control of Use) Regulations 2007 govern the use of agricultural and veterinary chemicals such as 1080 pest animal bait products in Victoria.
The Occupational Health and Safety Act 2004 and the Occupational Health and Safety (Hazardous Substances) Regulations 1999 make provision to maintain a safe working environment including the handling and use of agricultural chemicals.
3 Authorisation for the Use of 1080 Pest Animal Bait Products
3.1 Authorised persons
The Agricultural and Veterinary Chemicals Code Act 1994 states that restricted chemical products (including 1080 pest animal bait products) can only be supplied to 'authorised persons'.
An 'authorised person' (also known as authorised users or bait users for the purposes of this document) for the supply and use of 1080 pest animal bait products includes:
- A person who holds a valid Agricultural Chemical User Permit (ACUP) with a 1080 endorsement issued under the Agricultural and Veterinary Chemicals (Control of Use) Act 1992; or
- A person or entity who holds a valid Commercial Operator Licence (COL) with a vermin destroyer endorsement issued under the Agricultural and Veterinary Chemicals (Control of Use) Act 1992 or are the staff of that COL holder who have successfully completed a Course in Minimising the Risks in the Use of 1080 Pest Animal Bait Products for Vertebrate Pest Control; or
- A person who holds a valid Licence to Use Pesticides (LTUP) issued under the Health Act 1958 with an authorisation to use pesticides formulated for the control of any pest animal and to protect an area or place in, or around, a building used for commercial or domestic purposes.
To become authorised, a person must successfully complete specific training.
Note:
- A person may use an 'agent' to purchase 1080 pest animal bait products on their behalf. The agent must be an authorised person who must present their valid authorisation and the valid authorisation of the person for whom they are purchasing the bait and who is named on the Bait User Declaration (see Appendix A). An agent can only supply the purchased baits to the authorised person stated on the Bait User Declaration.
- A person who is not an authorised person may use 1080 pest animal bait products under the direct and immediate supervision of a person holding a valid 1080-endorsed ACUP, providing that 1080 pest animal bait products are being used in accordance with the directions on the product label, the relevant MSDS and this document.
3.2 Requirements of bait users
Authorised users of 1080 pest animal bait products must:
- Use 1080 pest animal bait products in accordance with:
- the product label; and
- the relevant MSDS; and
- relevant Commonwealth and State legislation; and - Comply with the current version of Directions for the Use of 1080 Pest Animal Bait Products in Victoria (i.e. this document) including:
- - conducting a risk assessment before purchasing 1080 pest animal bait products; and
- signing a Bait User Declaration and presenting it to the authorised or accredited retailer at the point of bait purchase; and - Keep records of use (including a copy of the risk assessment) for a minimum period of two years.
4. Using 1080 Pest Animal Bait Products
Users of 1080 pest animal bait products are responsible for complying with the directions on the product label, the relevant MSDS and this document. Non-compliance with the directions on the product label is an offence.
The details on the product label have been developed and approved to ensure that:
- the product can be safely used for the purposes for which it was registered; and
- appropriate precautions are taken to minimise risk to the user and others (including notification to neighbours, warning signage, minimum distances to dwellings and waterways etc.); and
- non-target species are not exposed to unnecessary risks.
4.1 Risk assessment
Before purchasing or using any 1080 pest animal bait product, the prospective bait user must assess the risks associated with 1080 bait use. The risk assessment2 assists in determining if baiting is an appropriate pest animal control strategy, the likely quantities of bait required and identifies potential risks that will need to be mitigated (eg. non-target species).
The bait user is responsible for assessing and managing the risks associated with the use of 1080 pest animal bait products. Risk assessment documentation must be completed prior to the purchase of 1080 pest animal bait products. A copy of the risk assessment must be kept by the bait user.

4.2 Purchasing 1080 pest animal bait products
1080 pest animal bait products may only be supplied by accredited or authorised retailers. At the point of sale, the purchaser must:
- present their valid ACUP (with 1080 endorsement), COL (with vermin destroyer endorsement) or LTUP (with authorisation to control pest animals); and
- present a signed Bait User Declaration for countersigning by the retailer.
4.3 Transport of bait
1080 pest animal bait products must be transported in accordance with the directions on the product label, the relevant MSDS, this document and all other relevant Acts, Regulations, Codes and statutory requirements.
1080 pest animal baits must be transported in a secure and safe manner in such a way that the product is not lost in transit and that the packaging remains intact to prevent access and exposure to unauthorised persons, pets or livestock. A bait user must, as soon as possible after being issued with 1080 pest animal bait products, transport those baits by the most direct route to the land on which the baits are to be laid or stored pending their use.
4.4 Storage of bait
The storage of 1080 pest animal bait products must be done in accordance with the directions on the product label, the relevant MSDS, this document and all other relevant Acts, Regulations, Codes and statutory requirements.
1080 pest animal bait products must be stored in a secure and safe manner in such a way that unauthorised persons, pets or livestock cannot have access to 1080 pest animal bait products. 1080 pest animal bait products must be kept or stored only in the original container and bearing the original label as supplied by the manufacturer.
Baits must not be stored after a baiting program is complete.
4.5 Notification to neighbours
A person who intends to use 1080 pest animal bait products must provide written notification to all occupiers of land which adjoins the land on which the bait is to be laid (see Glossary for definition of adjoining neighbour).
Written notification must be provided at least 72 hours in advance of baiting. If baiting does not commence within 10 days of notification, a further 72 hours written notice to neighbours of intent to lay baits is required.
Notification must specify:
- the dates between which baiting will occur; and
- that steps (eg. muzzling, restraint) need to be taken to ensure that domestic dogs do not gain access to 1080 pest animal baits or poisoned animals.
For baiting programs that are continuous or run for extended periods of time, written notification to neighbours (in accordance with the above requirements) must occur every 12 weeks.

4.6 Signage
Signage warning that 1080 pest animal bait products have been placed on that land must be displayed on all lands on which baiting occurs to inform people using or entering the land of the potential risk. Signs must be erected at all vehicular entry points and any other commonly used entry points to the land immediately before 1080 pest animal bait products are laid on the land. Warning signs must:
- display the word 'warning' or 'poison'; and
- state that domestic animals and pets may be affected; and
- state the pest animal targeted by baiting; and
- state the type of poison being used; and
- state the date/s that baits will be laid; and
- state a valid contact telephone number for further information (this must be the telephone number of the owner or manager of the land on which the baiting is occurring or the person responsible for laying the baits).
Signs must remain in place until four weeks after the baiting program has been completed after which time the signs must be removed.
For baiting programs with a duration of greater than four weeks or continuous baiting programs, signs need to be regularly checked and maintained to ensure they remain legible.
Warning signs cannot be removed from the land at any time while 1080 pest animal bait products are present on the land. Signs must be:
- weather-resistant; and
- A5 or greater in size; and
- display bold writing (written in English) in easily detectable colours; and
- display a minimum font size of 20pt (4mm).
4.7 Reducing potential harm to non-target wildlife
To reduce the potential harm to non-target wildlife:
- bait users must comply with free feeding directions on the product label (if applicable); and
- bait placement and/or bait placement design must be such that non-target access is minimised; and
- baits must not be laid at times when, or in locations where, birds or other non-target wildlife are likely to be harmed by them; and
- potential risks must be reduced by correct bait placement, selection of the minimum effective baiting rate and avoidance of baiting during the non-target wildlife's main breeding seasons.
Steps (eg. restraint, muzzling) must also be taken to ensure that domestic dogs or other domestic animals do not gain access to 1080 pest animal bait products or poisoned animals.
When trail baiting, aerial or ground broadcast baiting, a person must not allow domestic stock owned by or under the control of that person, to access any land on which bait has been placed until: .
- the baiting has been completed; and
- to the extent possible efforts have been made to collect and destroy uneaten bait to prevent access by domestic stock and non-target species.
4.8 Distance restrictions
Users must adhere to minimum distance requirements when laying bait. The minimum distance requirements are specified below:

4.9 Laying of baits
The 1080 pest animal bait' product label describes the rate at which bait must be laid and the method by which it must be placed (including burial) on land. Users of bait products must follow all directions on the product label when laying baits (including free feeding requirements and application rates) and refer to the MSDS for additional information on safe use.
Bait users must check product labels to ascertain whether aerial application is a permitted use of a 1080 pest animal bait product. In Victoria, the aerial application of 1080 pest animal baits for pest animal control is restricted to the use of carrots for rabbit control only.
Bait users must check baits and bait stations in accordance with the relevant product label directions. Further information on bait quantities and the laying of baits can be found in the references listed in Section 10 of this document.
1080 pest animal bait products must be laid as soon as possible after the time of their purchase and must not be stored beyond the period of the baiting program. As well as adhering to the product label, bait users must adhere to the timeframes in the following table with respect to bait lay, bait recovery and bait disposal/destruction.

4.10 Bait and carcass disposal
4.10.1 Bait disposal
To the extent possible bait users must collect unused baits in accordance with the timeframe's specified in Table One.
Untaken and unused baits for the control of foxes, wild dogs and feral pigs must be buried to a depth of at least one metre or incinerated.3
Untaken and unused baits for the control of rabbits must be buried to a depth of at least 50 centimetres or incinerated.3
4.10.2 Carcass disposal
All reasonable steps must be taken to recover the carcasses of poisoned animals during and for 14 days after the baiting program. Carcasses must be buried or destroyed as follows:
- carcasses of foxes, wild dogs and feral pigs must be buried to a depth of at least one metre or incinerated 3;
- carcasses of rabbits must be buried to a depth of at least 50 centimetres or incinerated 3.
4.11 Disposal of containers
Containers which have held 1080 pest animal bait products are not to be used for any other purpose and must be disposed of in accordance with the product label directions, the relevant MSDS, this document and local legislative requirements.
If no landfill is available, bury the containers below 0.5 metres in a disposal pit specifically marked and setup for this purpose clear of waterways, desirable vegetation and tree roots.
5. Safety Directions
Bait users must comply with the safety directions and first aid instructions on the product label, the relevant MSDS and this document. 1080 is highly toxic and must be handled with care. There is no effective antidote to 1080.
If poisoning occurs, speed in treatment is essential and hospitalisation is likely to be needed. If poisoning occurs contact a doctor or the Poisons Information Centre immediately on 13 11 26.
1080 is a very dangerous poison that is harmful if swallowed. Users must:
- wear elbow-length PVC gloves when opening 1080 pest animal bait product containers and handling bait products - these gloves should be washed thoroughly in running water immediately after each use; and
- wash contaminated clothing thoroughly after each day's use; and
- wash their hands, arms and face thoroughly with soap and water (after removal of gloves) after each day's use and before smoking, drinking or eating.
If product comes in contact with skin, remove contaminated clothing and immediately wash skin thoroughly with soap and water.
6. Record Keeping
Persons using 1080 pest animal bait products must make within 48 hours of use, and keep for a period of two years after the date of use, an accurate written record of the use in accordance with the Agricultural and Veterinary Chemicals (Control of Use) Regulations 2007.
7. Occupational Health and Safety
Persons using 1080 pest animal bait products in their workplace are required to assess occupational health and safety risk and implement control options in accordance with the Occupational Health and Safety Act 2004, Occupational Health and Safety (Hazardous Substances) Regulations 1999 and the relevant MSDS for 1080 pest animal bait products.
The management and handling of 1080 pest animal bait products must be conducted in accordance with the Occupational Health and Safety Act 2004, Occupational Health and Safety (Hazardous Substances) Regulations 1999 as well as any associated Standards, Codes and statutory requirements.
8. Incident Reporting
Any incidents where it is suspected that non-target animals have been poisoned by 1080 pest animal bait products must be notified immediately to DPI on 136 186.
Bait users must also comply with incident notification requirements under the Occupational Health and Safety (Incident Notification) Regulations 1997.
9. Review and Update of Directions for the Use of 1080 Pest Animal Bait Products in Victoria
This document will be reviewed every five years. However, DPI may initiate a review at any time.
