Review of Plant Biosecurity legislation

    Following the release of a Discussion Paper in May 2008, the next phase of the review process entails a submission for approval by Cabinet containing drafting instructions for the Plant Biosecurity Bill and a Business Impact Assessment (BIA).       Summary

      The Victorian
      Plant Health and Plant Products Act 1995 (the Act) provides the framework for the prevention, monitoring, control and eradication of plant pests and diseases in Victoria. The Act aims to protect Victorian plant industries from the impact of pests and diseases whilst causing minimal disruption to trade.

      The Plant Health and Plant Products Regulations 2006 support the operation of the Act.

      The Act, via Orders-
      • may prohibit the movement of certain material into Victoria to prevent the entry of exotic pests and diseases detected in other States or Territories, into Victoria;
      • allows areas in Victoria to be declared, and conditions imposed on the movement of certain materials, to prevent the entry of a pest or disease into that area;
      • allows areas in Victoria to be declared, and conditions imposed on the movement of certain materials, to prevent the spread of a pest or disease from that area.
      Current orders are shown in the tables below. Those orders that have expired or been revoked can be viewed on the Government Gazette website (external site).

      Declared Exotic Pests and Diseases

      A pest or disease is classified as a declared pest or disease PDF 60KB), an exotic pest or disease (PDF 81KB) or a notifiable pest or disease (PDF 25KB).

      Importation Orders

      The following Orders are in place which restrict or prohibit the movement of plants, plant materials and other items into Victoria to prevent the entry of specified pests or disease- A summary of these is provided in the Plant Quarantine Manual.
